BEYOND AQUATICS LIABILITY WAIVER AND RELEASE

Basically, this amazing document says two things: 1) You will not sue us for anything, and 2) In order to keep costs lower, if you miss or cancel an appointment less than 24 hours prior, you are still charged for said appointment.

Because aquatic physical exercise can be strenuous and subject you to the risk of serious injury, Beyond Aquatics recommends that you obtain a complete physical examination from a licensed board-certified physician before any aquatic therapy, use of aquatic exercise equipment, or participating in any aquatic program. You agree that by participating in aquatic therapy, exercise, and all programs/services offered, you do so entirely at your own risk. You agree that you are voluntarily participating in these activities and use of the aquatic center premises. You agree that you assume all risks of injury, illness, drowning, or death from all causes for yourself and all those in your care or under your charge. You understand that falls are a problem in aquatic areas like Beyond Aquatics, where there is water on the floors, pool steps, and all other areas. You always agree to use caution. If you need help, it is your responsibility to ask for whatever assistance is needed. You specifically hold Beyond Aquatics and its associates harmless from any type of fall that occurs either getting into or out of the pools, moving alongside the pools, in the bathrooms, the HydroMassage room, the hallway and lobby, sidewalks, the parking lot, and all other locations whether you fall yourself or whether someone else is involved in the fall or assisting you after your fall in any capacity. You assume responsibility for any personal articles you bring into the facility. Beyond Aquatics provides lockers and recommends the use of personal padlocks to secure personal articles. Valuables should be secured either in a personally locked locker or in your vehicle. Beyond Aquatics does not assume responsibility for any lost or stolen property. You understand that if you make a reservation for services and cancel your appointment within 24 hours of the appointment or do not show up for your appointment, you will automatically be charged for your appointment, which is equal to the amount designated by the reservation. You acknowledge that you have carefully read this "Waiver and Release" and fully understand that it is a release of liability. You expressly agree to release and discharge Beyond Aquatics, Serenity Therapies L.L.C., any therapist, trainer, instructor, volunteer, intern, event host, business owner, and anyone else who is working with Beyond Aquatics from all claims or causes of action, and you agree to voluntarily give up or waive any right that you may otherwise have to bring legal action against Beyond Aquatics, therapist, trainer, instructor, volunteer, intern, event host, business owner, or other person for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this "Waiver and Release" includes negligence. If you or your group is responsible for breaking our equipment, other than normal wear and tear, you will be held liable to cover the cost of replacement, and this may be charged to your payment method if a payment plan is not agreed upon. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this "Waiver and Release" from liability shall remain in full force and effect, and the offending provisions severed here from.

All questions I may have about this "Waiver and Release" have been answered to my satisfaction. Being of sound mind, I have signed this agreement of my own free will and without duress. By signing this release, I acknowledge that I fully understand its content and that this release cannot be modified orally.
